The following terms and conditions (“TOS”) govern all use of the pcmnet.cloud website (“Website”) and all content, services and products available at or through the Website (“Services”). The Website is owned and operated by coach2market srl (“C2M”) consulting firm, via Guido Reni, 56, 00196 Roma, Italia. Our Services are offered subject to your acceptance without modification of all of the terms and conditions contained herein and all other operating rules, policies and procedures that may be published from time to time on this site by C2M.

Please read the TOS carefully before accessing our Website or using our Services. By accessing or using any part of the Website, you agree to become bound by the TOS. If you do not agree to all the TOS, then you may not access the Website or use any Services.

2. Your PCM NET Account

A member account (“Account”) is the area in our Website, which is accessible via a password and contains personal information regarding the user. If you create an Account on the Website, you are responsible for maintaining the security of your Account and fully responsible for all activities that occur under the Account and any other actions taken in connection with the Account. You must immediately notify C2M at staff@coach2market.com of any unauthorized uses of your Account or any other breaches of security. C2M will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions. Registration of a user requires the user to provide a valid e-mail address for the communication between PCMNET and the user along with a valid name, amongst other information required pursuant to Section 5 below.

3. Responsibility of Website Visitors

C2M cannot review all of the material posted on the Website and cannot therefore be responsible for that material’s content, use of effects. By operating the Website, C2M does not represent or imply that it endorses the material posted there, or that it believes such material to be accurate, useful or non-harmful. You are responsible for taking precautions as necessary to protect yourself and your computer systems from viruses, worms, Trojan horses and other harmful or destructive content. The Website may contain content that is offensive, indecent or otherwise objectionable, as well as content containing technical inaccuracies, typographical mistakes, and other errors. The Website may also contain material that violates the privacy or publicity rights, or infringes the intellectual property and other proprietary rights, of third parties, or the downloading, copying or use of which is subject to additional terms and conditions, stated or unstated. C2M disclaims any responsibility for any harm resulting from the use by visitors of the Website, or from any downloading by those visitors of content there posted.

We have not reviewed, and cannot review, all of the material made available through the websites and webpages to which pcmnet.cloud links, and that link to pcmnet.cloud does not have any control over those third party websites or webpages and is not responsible for their contents of their use. By linking to a non- pcmnet.cloud website or webpage, pcmnet.cloud does not represent or imply that it endorses such websites or webpages.

5. Ownership & responsibilities

C2M is the owner of the PCMNET web app, resident / accessible on the pcmnet.cloud domain, and its subsequent marketing as a support for the implementation of PCM training programs among users. C2M qualifies as a holder with regard to the processing of personal data carried out with the PCMNET app. Ownership refers to the processing of personal data, as defined by art. 4 of the GDPR and concerns the processing of all data already present in both paper and computerized archives, and of all those that will be acquired in the future.

Starting from 25 May 2018, the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 is in force "concerning the protection of individuals with regard to the processing of personal data, as well as the free circulation of such data and repealing Directive 95/46 / EC (General Data Protection Regulation) "(hereinafter GDPR);

C2M is aware of the specific risks that exist for the processing of personal data and of the preventive and emergency measures to be taken in relation to the activities, and takes into account the state of the art and the costs of implementation, as well as the nature, scope of application, of the context and of the purposes of the processing, as well as of the risks having different probabilities and gravities for the rights and freedoms of the natural persons constituted by the treatment, both when determining the means of treatment and when processing the same, yes obliges to implement adequate technical and organizational measures, aimed at:

  • Ensure that the personal data being processed are processed lawfully and fairly, and in full compliance with the applicable legislation;
  • Minimize the risk of destruction or loss, even accidental, of the data itself, of unauthorized access, of processing that is not permitted or does not comply with the purposes of the collection
  • Effectively implement the principles of data protection and security, such as minimization, and integrate into the processing the necessary guarantees in order to meet the requirements of the GDPR and protect the rights of the data subjects.

6. Activities and obligations of C2M

  • Development and maintenance of the PCMNET app, also as a "system administrator" (with the functions and obligations identified by the provision of the Data Protection Authority 27.11.08, web doc. 1577499);
  • Processing of data collected through the PCMNET app and through the site https://app.pcmnet.cloud, including data relating to billing to users
  • Organizational and technical requirements connected with the security of the data processed with / by the PCMNET app, with respect to unauthorized access and / or use or for purposes other than those to which the app is directed;
  • Top-level user support;
  • Maintenance of the register of treatments in accordance with current legislation;
  • Reporting of any "data breach".
  • To distribute to the trainers, and through them to the customers, the privacy information, in order to acquire the first consent for the activation of the user for the PCMNET app;
  • Receive requests relating to the exercise by the interested parties of the rights provided for in their favor by the regulations in force concerning the processing of data, as indicated in the information signed by them.
